# AI Transparency & Content Disclosure Statement

## 1. Purpose and Scope

This statement explains when and how kōdōkalabs tells you that you are dealing with AI, and how it discloses AI-generated or materially manipulated text, images, audio and video.

It applies to this website and to other public content published under the kōdōkalabs name. It sits alongside the AI Ethics & Safety Statement, which describes the responsible-AI controls behind kōdōkalabs’ work, and the [Privacy Policy](./privacy-policy.md), which explains how personal data is processed.

Where a disclosure to a person is required, it must appear clearly and accessibly at the point of interaction or exposure. A general page like this one does not replace that local notice. Whether and how a disclosure is needed depends on the system, the content, the context, the degree of AI involvement, kōdōkalabs’ role, human review, editorial responsibility, contract, platform rules and law.

## 2. How kōdōkalabs Uses AI

kōdōkalabs uses AI technologies, including Large Language Models (LLMs), to assist in content generation, strategy formulation and data analysis. AI may support research, analysis, drafting, workflow design, agent implementation, training and operational improvement.

The tools currently used for published content are:

- **Text:** Gemini is used for content creation.
- **Images:** Nano Banana Pro and ChatGPT are used to create images.
- **Video:** AI video is made with Higgsfield. No AI-generated video is published on this website at the moment.
- **Audio:** audio is not created with AI.

AI-generated text is not treated as evidence because it is fluent or confident. Material factual claims are checked against an identifiable source, approved data, direct observation or a reproducible calculation. AI technologies can occasionally produce incorrect or “hallucinated” information, even with a human-in-the-loop verification process.

Some images on this website are AI-generated. Section 4 explains how they are marked and where they are listed. AI-generated video, if it is published, is covered by the same rules.

## 3. Human Review and Editorial Responsibility

Human expertise remains responsible for the business purpose, evidence, decisions, approvals and consequences of kōdōkalabs’ work. A named person owns the purpose, evidence, review, approval and escalation decision. AI systems do not act as the final accountable decision-maker. An AI system may recommend, organize, transform or generate material within an approved workflow, but it may not approve its own evidence, waive a control or authorize its own deployment.

AI-assisted work is designed around three human decision gates: approval of sources and evidence, strategic and editorial approval, and approval for publication, deployment or scale. Client-facing or public content receives subject-matter review plus evidence and strategic or editorial approval.

kōdōkalabs is founder-led. Ben Moll, Founder/CEO, reviews and approves all published text and holds editorial responsibility for it. Until responsibilities are formally delegated, he is also the policy owner and the final escalation point.

## 4. How AI-Generated Images Are Marked

AI-generated images on this website are marked in three ways:

- **At the image.** Every AI-generated image on this website shows a small visible “AI-generated” note on the image.
- **In the file.** The image file carries the IPTC digitalSourceType value `trainedAlgorithmicMedia` in its metadata. This marking is kept in the optimized versions of the image that the site serves.
- **In a public register.** Every AI-generated image is listed in the [AI Image Register](./ai-image-register.md), with the page where it is used, the tool or model, the approval date and the label.

The visible note, the file marking and the register complement each other; none of them replaces a notice that the law or a platform requires in a particular case (see section 1).

## 5. The Legal Frame

Article 50 of the EU Artificial Intelligence Act (Regulation (EU) 2024/1689) sets transparency obligations for certain AI systems and AI-generated content. These obligations apply from 2 August 2026. In summary:

- Deployers of an AI system that generates or manipulates image, audio or video content constituting a deepfake must disclose that the content has been artificially generated or manipulated.
- Deployers of an AI system that generates or manipulates text published to inform the public on matters of public interest must disclose that the text has been artificially generated or manipulated, unless the content has undergone human review or editorial control and a natural or legal person holds editorial responsibility for its publication.
- The information must be provided in a clear and distinguishable manner at the latest at the time of the first interaction or exposure.

kōdōkalabs refers to the Code of Practice on marking and labelling AI-generated content (published in June 2026) and to the Commission’s guidelines on Article 50. See the [European Commission guidance on transparency obligations](https://digital-strategy.ec.europa.eu/en/policies/guidelines-ai-transparency-obligations) and the [Code of Practice on Transparency of AI-Generated Content](https://digital-strategy.ec.europa.eu/en/policies/code-practice-ai-generated-content).

This section describes the legal baseline kōdōkalabs uses. It does not mean that kōdōkalabs has received a certification, regulatory endorsement, conformity assessment or legal determination of compliance, and it is not legal advice. Applicability depends on the specific system, operator role, content, context and market.

## 6. What kōdōkalabs Does Not Do

The baseline acceptable-use policy in the AI Ethics & Safety Statement prohibits:

- deceptive impersonation;
- undisclosed deepfakes within the scope of the law;
- fabricated sources, testimonials, credentials, case studies or performance evidence;
- publishing unreviewed AI output as verified fact.

Under the same policy, realistic synthetic media is a restricted use that requires the checks appropriate to the risk and explicit approval before use.

## 7. Questions and Concerns

Questions, complaints, suspected omissions and content concerns can be raised through [Contact](./contact-kodokalabs.md). Choose the enquiry type “AI ethics or content concern”. Privacy concerns should also follow the route published in the [Privacy Policy](./privacy-policy.md).
